Last updated: 28 October 2026 | Version 1.3

1. Provider and Scope

1.1 These Terms and Conditions (T&C) apply to the provision and use of the “Breathe Balloon” application (hereinafter the “App”) for iOS, iPadOS, macOS, watchOS and Android, which is offered through the Apple App Store and Google Play.

1.2 The provider of the App is:

DoPe Apps – Dominik Peuscher
Sole proprietorship

c/o MDC#1496

Germany

Email: business@dpeuscher.de
Phone: +49 8990422549

1.3 These T&C contain supplementary provisions on the use of the App, its range of functions, and on safety information and rights of use. They apply to users insofar as they have been effectively incorporated into the respective contractual relationship.

1.4 For purchase and use through the Apple App Store, the applicable Apple Media Services Terms apply and, unless an individual end user license agreement is provided, Apple’s Standard End User License Agreement (Standard EULA).

1.5 For purchase and use through Google Play, the applicable Google Play Terms of Service apply.

1.6 These T&C supplement the respective platform terms, to the extent legally permissible and provided there are no conflicting agreements that take precedence. They replace neither mandatory statutory provisions nor the users’ rights under applicable platform agreements.

2. Purpose and Scope of Functions

2.1 Breathe Balloon is an application that supports mindful breathing, relaxation and general well-being.

2.2 The App offers various preset breathing exercises, including box breathing, extended exhale, coherent breathing, resonance breathing, 4-7-8 breathing and slow breathing.

2.3 In addition, users can set individual breathing rhythms. This function is intended in particular for carrying out exercises previously recommended by a physician or breathing therapist.

2.4 The breathing exercises are accompanied by visual animations and, where applicable, music or audio signals.

2.5 According to the provider’s intended purpose, Breathe Balloon is intended exclusively as a wellness and relaxation application. The App is not intended for the medical diagnosis, monitoring, prevention or treatment of diseases and is not offered as a medical device.

2.6 The App does not replace medical advice, medical examination, treatment or professional breathing therapy. No particular health or therapeutic outcome is guaranteed.

2.7 Information on breathing techniques and scientific publications serves exclusively as general information and does not constitute personal medical recommendations.

3. Eligibility and Minimum Age

3.1 The App is generally intended for persons aged 12 and over, provided the respective breathing exercises are suitable for them.

3.2 Minors may use the App only with the consent of their parents or legal guardians. For purchases against payment, the statutory provisions on the legal capacity of minors apply.

3.3 For children under 12, use is recommended only under the direct supervision of an adult and after prior consultation with a professional. The App has not been developed specifically for independent use by children.

3.4 The suitability of individual breathing exercises depends, among other things, on age, physical condition and health conditions. Even when the recommended age limit is observed, an individual assessment is required.

3.5 If there are health limitations or uncertainty about the suitability of an exercise, medical advice must be obtained before use.

4. Purchase, Prices and Payment

4.1 Breathe Balloon is offered as a paid application for a one-time purchase through the Apple App Store and Google Play.

4.2 The purchase price is displayed in the respective app store before purchase. The price stated at the time of purchase applies.

4.3 By purchasing, the user obtains the right to use the App within the scope of the applicable license and terms of use.

4.4 No subscription fees, automatically recurring payments or additional in-app purchases are incurred.

4.5 Payment processing and, where applicable, refunds are governed by the statutory provisions and the applicable terms of the respective app store.

4.6 Re-downloading the purchased App is governed by the technical options and terms of the respective app store and by statutory entitlements.

4.7 No separate user account with DoPe Apps is required to use Breathe Balloon.

5. General Safety Information

5.1 Medical Consultation

Before using Breathe Balloon, a physician should clarify whether the breathing exercises offered are suitable for the person concerned. This applies in particular in the case of existing illnesses, health limitations, respiratory or cardiovascular diseases, and during pregnancy.

5.2 Physical Limits

Breathing exercises may only be carried out for as long as, and at an intensity at which, they feel comfortable. Particularly deep breaths, very slow or fast breathing rhythms, and holding the breath must not be forced.

5.3 Safe Environment

Breathing exercises should only be carried out in a safe position, preferably sitting or lying down.

The App must not be used in situations in which dizziness, reduced attention or other physical reactions could pose a danger to the user or others. These include, for example, driving, being in water, operating machinery, or activities with an increased risk of accident.

These examples are not exhaustive. Before every exercise, make sure that the environment is safe and that the exercise can be interrupted safely at any time.

5.4 Breathing Pauses and Breathing Rates

Longer breath-holding phases in particular, unusual breathing rates and excessively deep breathing can cause physical discomfort. Preset breathing rhythms should not be changed independently without prior professional consultation.

5.5 Warning Signs

If physical or psychological symptoms occur during a breathing exercise, for example dizziness, nausea, tingling, headache, racing heart, shortness of breath or feelings of anxiety, the exercise must be ended immediately and natural breathing resumed.

This list is not exhaustive. Even in the case of other unusual or unpleasant reactions, the exercise should be stopped without delay.

If symptoms persist or worsen, medical advice should be sought. In the case of severe symptoms, for example chest pain, fainting or pronounced shortness of breath, medical emergency help must be sought immediately (emergency number 112 in Germany).

5.6 No Medical Treatment

Breathe Balloon is to be used with regard to one’s personal physical limits and the safety information above. The App does not replace medical or therapeutic treatment.

The statutory liability rights of users remain unaffected.

6. Individual Breathing Exercises

6.1 The “Custom breathing” function allows users to set the duration of inhalation, exhalation and breath-holding phases themselves.

6.2 It is intended for carrying out, with the help of the App, a breathing rhythm previously agreed with a physician or breathing therapist.

6.3 Users should not try out or put together arbitrary breathing rhythms without professional consultation.

6.4 Breathe Balloon does not check individually set breathing patterns for their medical suitability, safety or effectiveness.

6.5 The App cannot determine whether a set rhythm suits the individual health situation or whether unknown health risks exist.

6.6 Users should adhere to the breathing times, numbers of repetitions and restrictions recommended by professionals. In the event of symptoms, the exercise must be ended immediately.

7. Use by Professionals and in a Professional Context

7.1 The versions of Breathe Balloon for iOS, iPadOS, macOS and watchOS obtained through the Apple App Store may also be used by breathing therapists, other professionals and institutions in the course of their professional activities, insofar as this is compatible with Apple’s applicable license terms.

7.2 Using the versions for iOS, iPadOS, macOS and watchOS to guide breathing exercises in paid individual or group sessions is generally permitted. DoPe Apps charges no additional license fee for this.

7.3 The Android version obtained through Google Play is intended exclusively for private, non-commercial use. Professional or commercial use is not permitted.

7.4 The permission for professional use of the versions for iOS, iPadOS, macOS and watchOS does not entitle anyone to pass on, resell, independently reproduce or commercially distribute the App or its protected content.

7.5 Professional use must not give the impression that DoPe Apps has made a professional recommendation for particular persons, approved a therapy, or agreed on a collaboration with the respective professional.

7.6 Professionals remain responsible for the selection, guidance and professional assessment of the breathing exercises they use.

7.7 Use in a professional context does not establish a medical intended purpose of the App by DoPe Apps and does not replace any statutory or professional prerequisites of the respective activity.

8. Health Data and Integration with Apple Health and Health Connect

8.1 Breathe Balloon offers an optional integration with Apple Health (iOS) and Health Connect (Android). Through it, completed breathing exercises can be saved in the respective health platform.

8.2 The App transmits only the data intended for this function to Apple Health or Health Connect. Existing health data is neither read nor analysed.

8.3 Transmission takes place only with the user’s corresponding permission. This permission can be withdrawn at any time in the settings of the operating system or the respective health platform.

8.4 Use of the health integration is voluntary and is not a prerequisite for carrying out the breathing exercises.

8.5 The saved entries serve exclusively to document breathing exercises that have been carried out. They do not constitute a medical diagnosis, an assessment of health status or a treatment recommendation.

8.6 The further processing and management of the saved data within Apple Health or Health Connect is governed by the applicable privacy and terms of use of the respective platforms. Further information on data processing by Breathe Balloon is contained in the separate privacy policy.

9. Availability, Technical Requirements and Updates

9.1 Using the App requires a compatible device with a supported version of iOS, iPadOS, macOS, watchOS or Android.

9.2 Temporary restrictions may occur in particular due to software errors, necessary maintenance work, operating system changes or disruptions of external platforms.

9.3 DoPe Apps may technically further develop the App, fix errors and adapt functions within the limits permitted by law.

9.4 Necessary updates, in particular security updates, are provided in accordance with statutory provisions.

9.5 Material changes to contractually owed functions are made only to the extent permitted by law. Users’ statutory rights remain preserved.

9.6 Permanent compatibility with every device generation, operating system version or external interface is not guaranteed, unless statutory update and warranty obligations provide otherwise.

9.7 For functions that require an internet connection, additional connection costs may be incurred from the respective mobile or internet provider.

10. Rights of Use and Intellectual Property

10.1 The rights of use for Breathe Balloon are governed by the applicable license agreements of the respective platform and by the supplementary provisions of these T&C, insofar as these have been effectively agreed.

10.2 For use through the Apple App Store, Apple’s Standard EULA applies in particular, unless an individual EULA has been agreed. For use through Google Play, the terms of use and license terms applicable there apply.

10.3 The App and its content, including graphics, animations, texts, music, user interfaces and software components, may be subject to copyright or other protective rights to the extent legally protected in each case.

10.4 Independent distribution, marketing or reproduction of protected components is not permitted without corresponding authorization.

10.5 The included music may be played within the scope of the intended use of the App. Separate publication, distribution or commercial exploitation of the music is not part of the rights of use granted.

10.6 Uses permitted by law and rights under applicable open-source licenses remain unaffected.

11. Warranty and Limitation of Liability

11.1 The statutory warranty provisions apply to the provision and conformity of the App.

11.2 Breathe Balloon serves exclusively mindful breathing, relaxation and the promotion of general well-being. No particular health or therapeutic outcome is guaranteed.

11.3 The suitability of the breathing exercises offered depends on the users’ individual physical conditions. Breathe Balloon can neither detect nor assess existing or unknown illnesses or health risks. Users are therefore asked to have the suitability of the breathing exercises clarified medically before use and to observe the safety information.

11.4 Liability for other damage caused by slight negligence is excluded, unless material contractual obligations are breached. In the case of slightly negligent breach of material contractual obligations, liability for other damage is limited to the typical, foreseeable damage.

11.5 The above limitations of liability do not apply to damage resulting from injury to life, body or health, to damage resulting from intentional or grossly negligent breaches of duty, or in other cases of mandatory statutory liability.

12. Right of Withdrawal and Consumer Rights

12.1 Consumers are entitled to the statutory rights in respect of distance contracts and the purchase of digital products.

12.2 For purchases through the Apple App Store or Google Play, the respective purchase and processing procedures and the relevant statutory provisions apply.

12.3 A statutory right of withdrawal may expire early for digital content under the conditions provided by law, in particular where the user has duly consented to the start of performance of the contract and has acknowledged that this may result in the loss of the right of withdrawal.

12.4 There is no blanket waiver of statutory rights of withdrawal, warranty rights or other consumer rights.

12.5 Information on exercising existing consumer rights and on refunds is available through the respective app store or the competent contractual partner.

13. Data Protection

13.1 Information on the processing of personal data is contained in the separate privacy policy of Breathe Balloon.

13.2 This includes in particular information on the voluntary transmission of data to Apple Health or Health Connect and on any technical data processing.

13.3 The users’ data protection rights remain unaffected by these T&C.

14. Changes to the Terms of Use

14.1 DoPe Apps may amend these terms of use for future purchases, for example due to legal changes or new functions.

14.2 For contracts already concluded, changes apply only insofar as there is a statutory or effectively agreed contractual basis for them.

14.3 Necessary information on material changes will be provided in an appropriate manner.

14.4 Mandatory statutory claims remain unaffected.

15. Governing Law and Dispute Resolution

15.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

15.2 For consumers whose habitual residence is outside Germany, mandatory consumer protection provisions of their country of residence remain applicable insofar as they take precedence by law.

15.3 No exclusive place of jurisdiction is agreed with consumers. The statutory rules on jurisdiction apply.

15.4 Consumer Dispute Resolution

DoPe Apps is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

16. Final Provisions

16.1 Should individual provisions of these T&C be or become invalid, the remaining provisions remain effective, to the extent permitted by law. The statutory provisions take the place of invalid provisions.

16.2 Deviating individual agreements take precedence within the limits of the statutory provisions.

16.3 The current version of the T&C is made accessible within the App under “Settings” or via an associated website.
